General Terms and Conditions
for tours and events with "querfeldein Touren, 59872 Meschede"
 
Travel contract:
The subject of the contract is the provision of services on the basis of orders placed by the purchaser with the contractor (cross-country tours) with reference to this contract. The service covers guided tours as well as driving technique training for cyclists, mountain bikers and pedelec drivers (also called e-bikers).

Contract:
With the registration, which can be made in writing, by e-mail, orally or by phone, the customer offers querfeldein tours binding the conclusion of a contract for the event of a guided bike tour and or a driving technique training. The contract is concluded with the acceptance by the organizer. The customer receives a confirmation of the acceptance of the contract immediately after the conclusion of the contract. The confirmation will be sent by e-mail or in writing to the customer. The customer must sign this and return it with his contact details. Either by e-mail or by postal mail.

Pay:
Payment for services provided by cross-country tours must be paid directly to the bank account specified in the order confirmation. The payment is due immediately upon conclusion of the contract and must be paid by the customer at the latest 10 days before the start of the guided bike tour and / or the driving technique training.

Resignation:
The customer may at any time withdraw from the booked event without giving reasons. The resignation has to be written. The written form of § 126 BGB applies. In the case of a resignation, the compensation will be refunded to the customer without delay, provided that the declaration of withdrawal was received in cross-country tours 14 days before the tour or course date. If the cancellation is not received by the organizer by the above-mentioned date, the organizer reserves the right to withhold a cancellation fee. This amounts to 75% of the agreed remuneration.

Cancellation of the contract by the organizer:
The tours and courses take place in all weathers. Lasting experiences and learning successes are the order of the day even in bad weather. However, if the tour or course date is rendered impossible due to unforeseeable force majeure, the organizer may terminate the contract or offer alternative dates. The payments already made will be refunded immediately if necessary to 100%.

Eligibility:
Each participant in the driving technique course will be bound by the instructor or guide required to complete the guided tour and driving technique training. Each course participant must behave in such a way that other participants (as well as nature) are not disturbed and endangered. Repeated gross violations of the instructions of the guide may exclude the participant from the ride. A claim for repayment of the participation fee does not exist in such a case.

On a guided tour and on a driving technique course can only participate, who is fully roadworthy. Any impairment of the ability to drive, in particular due to alcohol or medication, will result in the exclusion of the guided tour and the driving technique training. Participants undertake to wear the required protective clothing during the tour, especially a cycling helmet. Without a cycling helmet, each participant is excluded from the course; there is no right to repayment of the course fee.

Limited release:
The guide is released from liability claims for damage to property and personal injury for the events offered by cross-country tours, unless they were caused by gross negligence or intent on the part of the guide. The customer is responsible for his own driving style and he is aware that during the guided tours as well as the driving technique training an accident risk and associated damage as well as a possible risk of injury (of whatever kind, ie lighter or even life-threatening injuries) can not be excluded. The customers undertake to wear a suitable bicycle helmet during the guided tours and driving technique training as minimum protection equipment and to follow the instructions of the guide.
